Instead, you’ll be wondering about things like when you’ll be able to walk again without pain, when you can return to work, and when you can enjoy life with your family again.
The Association of Personal Injury Lawyers’ (“APIL”) 2026 Industry Report (link to downloadable PDF) has highlighted that, for most people, rehabilitation is just as important as compensation.
There is a big shortfall between the number of injury victims as a whole and the number of injury victims who seek legal advice.
It appears that injured people do not know how much help they may be able to get through their solicitor with rehabilitation services rather than a solicitor’s aim just being to maximise the bottom line financial return via compensation.
The report found that 67% of people would be more likely to seek legal help if they knew a solicitor could help them access rehabilitation and rebuild their lives.
29% of people who suffered a negligence-related injury but did not go on to make a compensation claim said they held off because they were “focused on their recovery” and simply didn’t appreciate that a solicitor could help them recover their health.

In these situations, we covered the initial payment for the client to have the necessary treatment. These costs were claimable from the third party (or their insurers) as part of the client’s compensation and so we recouped our outlays at that stage.
While physiotherapy appointments, for example, must physically be attended in person, psychological therapy can effectively be delivered via online platforms such as Zoom. This is helpful both in terms of you, as the injured person, being able to fit such appointments into your daily schedule (e.g. avoiding the extra travelling time to get to and from meetings) and in terms of there being almost no readily available therapists based in the North of Scotland, let alone in Moray, in any event. For treatments such as Cognitive Behavioural Therapy (CBT) and its variants (e.g. “EMDR”), the increase in availability of remote treatment modalities (associated with the COVID-influenced move to online delivery in so many areas of life) is a real benefit for us here in Northern Scotland.
- The injured cyclist: After a collision with a motor vehicle at one of the A96 roundabouts in Elgin, our client suffered soft tissue injuries and went on to develop chronic pain in their lower back, with associated psychological consequences. We paid for them to have several sessions of CBT as part of their mental health recovery.
- The crush injury victim: This client was injured in an industrial workplace in Elgin when a heavy piece of metal landed on their hand. Despite safety gloves, one of their fingers was broken and crushed. They did not recover full use of the injured finger and could not bend it so as to be able to make a fist. The injured hand was particularly painful at night, leading to difficulty sleeping. Our client underwent private physiotherapy in Elgin and the physiotherapist fitted a specialised splint which alleviated many of the pain symptoms experienced in bed, leading to improved sleep quality and overall morale.
- The passenger in a life-threatening road traffic accident: Here, the Moray-based client was front-seat passenger in a camper van on the A96 near Nairn which collided with a car which negligently pulled out in front of them. Though the client did not have life-threatening injuries themselves, at the time, they feared that the occupants of the car might have been killed by the impact with a much larger vehicle (fortunately, they survived). A close, elderly relative in the rear of the camper van did suffer life-changing injuries, however, All of these stressors, coupled with the client’s whiplash injuries, led to the client being diagnosed with Post-Traumatic Stress Disorder as a result of the accident. They worked in an offshore job on supply boats and, on return to work after some months off post-accident, they were able to undertake remedial CBT therapy remotely from a variety of different locations. Over 10 sessions of psychotherapy, they experienced a considerable improvement in symptoms which had particularly affected them when driving (which had included them avoiding the scene of the accident by always diverting round it via back roads).
